By accessing and using the services provided by JB Travels ("Company," "we," "our," or "us"), you ("Client," "you," or "your") agree to be bound by these Terms and Conditions ("Terms"). These Terms constitute a legally binding agreement between you and JB Travels.

If you do not agree to these Terms, you must not use our services. Your continued use of our services constitutes acceptance of any modifications to these Terms.

2. Description of Services

JB Travels provides luxury travel planning and concierge services, including but not limited to:

  • Custom travel itinerary planning and booking
  • Luxury accommodation reservations
  • Private transportation arrangements (jets, yachts, ground transport)
  • Exclusive experience curation and booking
  • 24/7 concierge support during travel
  • Travel documentation assistance
  • Emergency travel support

We act as an intermediary between you and various travel suppliers. While we strive to provide accurate information, we do not guarantee the availability, quality, or performance of third-party services.

3. Booking and Reservations

3.1 Booking Process

All bookings are subject to availability and confirmation by suppliers. A booking is not confirmed until you receive written confirmation from JB Travels and any required deposits have been processed.

3.2 Pricing

All prices are quoted in USD unless otherwise specified and are subject to change until booking confirmation. Prices may vary based on:

  • Seasonal demand and availability
  • Currency fluctuations
  • Fuel surcharges and taxes
  • Supplier price changes

3.3 Special Requests

Special requests (dietary requirements, accessibility needs, room preferences) will be communicated to suppliers but cannot be guaranteed. Additional charges may apply for special accommodations.

4. Payment Terms

4.1 Payment Schedule

  • Deposit: 50% of total cost due upon booking confirmation
  • Final Payment: Remaining balance due 60 days before departure
  • Last-Minute Bookings: Full payment required within 24 hours of booking

4.2 Accepted Payment Methods

We accept major credit cards, bank transfers, and cryptocurrency payments. All payments are processed securely through encrypted payment systems.

4.3 Late Payment

Failure to make payments by the due date may result in booking cancellation and forfeiture of deposits. Late payment fees may apply.

4.4 Currency and Taxes

All prices are exclusive of applicable taxes unless stated otherwise. You are responsible for any taxes, duties, or fees imposed by relevant authorities.

5. Cancellation and Refunds

5.1 Client Cancellation

Cancellation fees apply as follows:

  • 90+ days before departure: 10% of total cost
  • 60-89 days before departure: 25% of total cost
  • 30-59 days before departure: 50% of total cost
  • Less than 30 days: 100% of total cost (no refund)

5.2 Supplier Cancellation

If a supplier cancels your booking, we will:

  • Provide alternative arrangements of comparable quality
  • Offer a full refund if alternatives are unacceptable
  • Not be liable for additional costs or compensation beyond the refund

5.3 Travel Insurance

We strongly recommend comprehensive travel insurance to protect against unforeseen circumstances. Insurance may cover cancellation fees, medical emergencies, and trip interruptions.

6. Travel Documents

6.1 Client Responsibility

You are responsible for ensuring you have valid travel documents, including:

  • Passport with at least 6 months validity
  • Required visas and permits
  • Health certificates and vaccinations
  • Travel insurance documentation

6.2 Documentation Assistance

While we provide guidance and assistance with travel documentation, you remain solely responsible for obtaining and maintaining valid documents. We are not liable for denied entry or travel disruptions due to inadequate documentation.

7. Client Responsibilities

7.1 Accurate Information

You must provide accurate and complete information, including:

  • Personal details and contact information
  • Dietary restrictions and allergies
  • Medical conditions and accessibility needs
  • Travel preferences and requirements

7.2 Conduct

You agree to:

  • Behave respectfully toward staff and other travelers
  • Comply with local laws and customs
  • Follow safety instructions and guidelines
  • Respect property and environmental conservation

7.3 Health and Safety

You are responsible for assessing your fitness for travel activities and obtaining appropriate medical clearance when necessary.

8. Limitation of Liability

8.1 Service Limitations

JB Travels acts as an intermediary and is not liable for:

  • Actions or omissions of third-party suppliers
  • Delays, cancellations, or changes by suppliers
  • Quality of accommodations or services
  • Personal injury, illness, or property damage
  • Loss or theft of personal belongings

8.2 Maximum Liability

Our total liability for any claim shall not exceed the total amount paid by you for the specific service giving rise to the claim.

8.3 Exclusions

We exclude liability for indirect, consequential, or punitive damages, including lost profits, business interruption, or emotional distress.

9. Force Majeure

Neither party shall be liable for failure to perform due to circumstances beyond reasonable control, including:

  • Natural disasters and extreme weather
  • War, terrorism, and civil unrest
  • Government actions and travel restrictions
  • Pandemics and health emergencies
  • Labor strikes and transportation disruptions

In such cases, we will work to minimize disruption and provide alternative arrangements where possible.

10. Intellectual Property

10.1 Our Content

All content on our website and materials, including text, images, logos, and designs, are protected by intellectual property rights and remain our property.

10.2 Limited License

We grant you a limited, non-exclusive license to use our content solely for personal, non-commercial purposes related to your travel planning.

10.3 Restrictions

You may not reproduce, distribute, modify, or create derivative works from our content without written permission.

11. Privacy and Data Protection

Your privacy is important to us. Our collection, use, and protection of your personal information is governed by our Privacy Policy, which is incorporated into these Terms by reference.

By using our services, you consent to the collection and use of your information as described in our Privacy Policy.

12. Dispute Resolution

12.1 Informal Resolution

We encourage resolving disputes through direct communication. Please contact our client services team first to discuss any concerns.

12.2 Mediation

If informal resolution fails, disputes may be submitted to mediation through a mutually agreed mediator.

12.3 Arbitration

Any unresolved disputes shall be settled through binding arbitration in accordance with the rules of the American Arbitration Association.

12.4 Class Action Waiver

You agree to resolve disputes individually and waive the right to participate in class action lawsuits.

13. Governing Law

These Terms are governed by the laws of the State of California, United States, without regard to conflict of law principles. Any legal proceedings shall be conducted in the courts of Los Angeles County, California.

14. Modifications

14.1 Terms Updates

We reserve the right to modify these Terms at any time. Changes will be effective upon posting on our website with an updated "Last Modified" date.

14.2 Notification

Material changes will be communicated via email or website notice. Continued use of our services constitutes acceptance of modified Terms.

14.3 Severability

If any provision of these Terms is deemed invalid or unenforceable, the remaining provisions shall remain in full force and effect.
